This story just keeps getting weirder and weirder: Marvin Harrison is getting sued over the off-season shooting incident:

Marvin Harrison's life just got more complicated.

The NFL star, who was linked to a springtime North Philadelphia shooting that left one man wounded, is being sued by the alleged victim, Dwight Dixon.

Harrison was never charged in the April 29 shooting, which occurred after he and Dixon exchanged blows near an auto-repair shop that Harrison owns on Thompson Street near 25th, according to police sources.

The case is still considered an open investigation, said Assistant District Attorney Christopher Diviny.

Although Harrison, 36, admitted to members of Central Detectives that he had been in the fight, he insisted that he had nothing to do with the shooting, the sources said.

His handlers maintained his innocence during the ensuing media firestorm.

The case eventually stopped generating headlines, and Harrison returned to his lucrative day job as a wide receiver for the Indianapolis Colts.

But over time, the investigation uncovered evidence that seemed to point in Harrison's direction:

* Harrison and Dixon squabbled for two weeks before the shooting after they exchanged words in Playmakers, a bar on 28th Street near Cambridge that Harrison owns.

* Ballistics tests proved shell casings found at the shooting scene had been fired from Harrison's gun, a Belgian-made FN5.7, law-enforcement sources said.

* Detectives found the firearm in Harrison's garage on Thompson Street.

* Witnesses and Dixon separately identified Harrison as the shooter, the sources said.

I'm not posting this to rub anything in at all, but from the day it broke in the off-season,  this has been one of the most unexpected stories I think I've ever seen.  That's a lot of not all that circumstantial evidence right there...  you wouldn't have to be Sam Waterston to make that case.

“The defendant intentionally and outrageously shot the plaintiff,” reads one portion of the lawsuit, while another section states that Dixon, 32, was shot by someone else who used Harrison’s gun.

“Look, it’s our position that Marvin Harrison was the shooter,” said Robert M. Gamburg, Dixon’s attorney.

“But even if you believe the other theory, Marvin’s gun was still used in the shooting, so he was negligent for leaving the weapon where someone else could obtain it.”

It’s a cash grab. They are just throwing everything out there and hoping something sticks or Marvin settles.

I guess this will quiet those (Florio) who suggested that Marvin paid the guy off to get out of criminal charges.

is the evidence they have. Only problem is, its the same god damn evidence they had since the start of this case that produced nothing. No disrespect to you, but there is no new development that proves marv is guilty in this article

But there's a world of difference between the burden of proof in a civil case vs. a criminal case

just ask OJ.

There is also a difference between the burden of proof for a indictment vs a civil case
In an indictment, a grand jury determines that there is sufficient evidence to believe a defendant may have committed a crime.

I'd also like to point out that this article

makes it 3 different places the police supposedly came into possession of Marvin’s gun.
Initially the report was it was found in a bucket at a car wash Marvin owns.
Then the report was Marvin handed the gun over to police himself.
Now the gun was found in his garage.

Good luck, Dwight. When the police have no evidence to suggest Harrison was at fault, it is going to be a tad difficult to convince a judge or jury to make him give you money.

They do have the ballistic report verifying that it was Marvins gun used in the shooting and in a civil case,where it’s easier to win a suit on circumstantial evidence, he may have to pay just for it being his gun.

As we all know from it being repeatedly printed in all the articles about this that in Philly if a gun owned by you is used in a shooting the owner can be found guilty of a misdemeanor.

Marvin's salary (without any bonus money)

is 7.6 million this year. If there was any chance something would come of this I think he’d be willing to part with less than 2% of what he’ll make this year alone.

is that Harrison has practically won this case before it even began. Not only is Dixon a felon, but he gave false evidence to the police.

Look I know the gun that was shot was Marvs

but dont you find it in the least bit suspicious that Dixon provided false info to the police, he is a convicted fellon, and the reports keep on changing? Its like someone who used identity theft used your credit card to make purchases, yet at the end you get off soctt free once you report it. Someone else used the gun (in this case the metaphoric Credit Card) they are the ones who are in trouble, not the owner.

As a Titans fan, I’d like thank you guys for not piling on right now.

The past few days have been dildos (any Metalocalypse fans out there?) for we Titans fans. You folks could have made it more frustrating and had a good laugh doing it, but you haven’t.

Harrison has not been charged with anything yet, and as shake said above, the gun has now been found at 3 different places. It is an obvious ploy for money, that is seen many times, as they figure the famous person will settle out of court, so as not to drag it out in public.

I'd say there's a big difference between the two situations.

One was a player possibly struggling with clinical depression (nobody’s fault), while the other is a police investigation into a shooting (somebody fired Marvin’s gun, unless it really is magic, which would make this case all the more interesting).

Also, I was compelled to leave that comment because the constraint shown by the BBS and the Stampede Blue commenters was the exception rather than the rule; this is closer to the Pacman garbage we had thrown in our face over and over by you kids than it is similar to VY’s ordeal.

And finally, what have I said that was out of line? I’m not calling the team thugs, I didn’t even say explicitly say Marvin did it. I haven’t said peep about our record or your record. I just think this story is interesting and nowhere near as cut and dry as you folks seem to think it is.

Again, has Harrison been charged with anything yet?

When did this happen again? The end of April, so almost 6 months ago, with no charges filed on anyone. Are the Philly cops just lazy? Are there so many other things going on that they haven’t had time? Really, what could be the reason for no charges being filed, other than no charges should be filed, especially after 6 months, with a high profile name involved?

Pacman was arrested, charged, and suspended from the NFL for an entire season. He has some serious character issues, which are well documented. I’d like to see this laundry list on Harrison.

I honestly don’t know who was over on the Titans site crowing about the Pacman deal, as I was not one of them. Every team has out of line fans, who live to only rile up opposing fan bases. It doesn’t make it right, and is what prompted me to point out you are better than that. I really enjoy reading your stuff over at MCM. However, every response from you in this thread has been trying to get a rise out of people. It is possible to intelligently discuss this matter without talking about “magic guns”, or taking an obvious joke seriously, trying to play the martyr. Two wrongs don’t make a right.

This situation should be cut and dry until any actual charges are filed in this case. Innocent until proven guilty.

Harrison is sued. The article is pretty hilarious. First of all, it omits the fact that the ‘victim’ is a felon (10 years for homicide). Secondly, it omits the fact that he was already charged with making false statements to the cops about this incident. What it does do is include this hilarious quote:

Gamburg, according to the Daily News. “But even if you believe the other theory, Marvin’s gun was still used in the shooting, so he was negligent for leaving the weapon where someone else could obtain it.”

So the dude’s attorney says, “Yeah, Marvin shot him, but even if he didn’t we still want money” That sounds like a real bang up case you got there, Mr. Lawyer-man. Have fun with that. Apparently the suit itself says that it is possible that someone else shot Dixon with Harrison’s gun. High comedy. The ‘victim’ apparently doesn’t know who shot him.

The case is only for $100,000, which seems really low to me. If there was anything to this, I’d think Marvin would have GLADLY settled it for that much or more.
